In a case involving driving under the influence of alcohol it was held that because defendant was not arrested within three hours of the charged offenses, as required by Va. Code Ann. § 18.2-268.2, the certificate of blood analysis obtained pursuant to that statute was inadmissible. Further, the exigent circumstances exception did not apply, and due to the significance of the same, its admission was not harmless error.
